Judge Desmond Hogan at Dublin Circuit Criminal Court sentenced Joseph Byrne to seven years in prison, suspended the final two years and ordered probation monitoring for 12 months after release. Byrne pleaded guilty to assault causing serious harm. The proceedings were reported on 9 November 2015.

The assault took place at Balbutcher Lane, Ballymun, on 4 February 2014. Byrne confronted a teenage boy on his way home from school, claiming he had Byrne’s Xbox. After the boy denied knowing anything about the console, Byrne slashed his face with a blade. The wound measured 10cm, extended between his ear and lip and needed 36 stitches. Permanent scarring was considered likely.

At a sentencing hearing in July, Garda Niall Minnock said Byrne had left belongings, including the Xbox, with a girl following their break-up. Byrne apparently believed the boy had the console. The boy was unknown to both Byrne and his former girlfriend.

Defence counsel Michael O’Higgins SC sought leniency. He said Byrne had schizophrenia and depression when the attack occurred, came from a good family and had subsequently begun addressing his mental health problems and drug addictions.

Byrne’s father apologised for his son’s conduct. He said stopping his medication had left Byrne severely confused and agitated, with occasional aggression.

Byrne had 15 previous convictions, two involving possession of knives. Judge Hogan placed the offence towards the most serious end of the scale and noted that the scar could affect the boy’s future employment interviews and social life. He also directed that Byrne receive the psychiatric assistance available during his imprisonment.
