John Gallagher received a consecutive three-year sentence, with the final 15 months suspended, for the knife-point robbery of taxi driver Nitesh Bhagat. Judge Martin Nolan imposed the sentence at Dublin Circuit Criminal Court on 17 July 2019.
Gallagher pleaded guilty to robbing Mr Bhagat of €200 and a mobile phone and to producing a knife in Tallaght on 20 October 2018. The proceedings were reported on 17 July 2019.
The sentence was consecutive to a previous three-year term for two other robberies, adding 21 months in custody to that term. The final 15 months were suspended on strict conditions. Gallagher had previously pleaded guilty to those robberies, which took place in Tallaght on 22 May and 19 October 2018.
Garda Brian O'Reilly told the court that Mr Bhagat picked Gallagher up from St James's Hospital. Gallagher sat behind him, put a knife to his throat and demanded his money and phone. Mr Bhagat grabbed the knife and was injured; he did not receive medical treatment. Garda O'Reilly said footage helped identify Gallagher, who later went to a garda station to hand himself in. Gallagher said he owed money to drug dealers who had threatened to shoot him in front of his children.
In his victim impact statement, Mr Bhagat said he had €1,000 in lost earnings as well as the money and phone taken. He described bruises and cuts, difficulty sleeping and being too afraid to work at night. Judge Nolan accepted that Gallagher had expressed deep remorse and shame and had written a letter of apology, but said the seriousness of the robbery required extra prison time.
