Former FAI chief executive John Delaney rejected claims that he was engaging in conduct that would paralyse the Office of the Director of Corporate Enforcement’s investigative powers. The High Court proceedings were reported on 23 July 2020.
Delaney sought more time to examine thousands of files, including emails, for material he said was protected by legal professional privilege. The ODCE opposed the request, saying its inspection timetable was achievable.
A determination on whether some files were covered by legal privilege had been due later in July. Following Delaney’s request for more time, that determination was not proceeding. Ms Justice Leonie Reynolds said the case would return before the courts in September.
