High Court permits challenge to Monkstown housing scheme; pre-construction works stayed

By Cathal Brosnan

This report is a localnews.ie summary based on public court reporting and records; sources are listed below.

The High Court granted Starrs Holdings Ltd permission to challenge An Bord Pleanála’s approval of a 300-unit housing development near Monkstown village in south Dublin. The judge also stayed pre-construction works that might affect trees, protected birds or bats, while allowing the developer to seek to lift the stay on notice to Starrs.

The permission allows Lulani Dalguise Ltd to build eight apartment blocks of five to nine storeys and 22 houses on a three-hectare site, and to convert Dalguise House into two dwellings and a creche. Starrs alleges the planning decision is flawed, including over road safety, traffic documentation, access across third-party lands and the impact of works on protected species. The developer is a notice party in the proceedings.
