The High Court granted an interlocutory injunction restraining Seán Quinn from trespassing on land owned by former Quinn Group companies on 25 May 2022.
The action was brought by Mannok Cement Limited and Mannok Build Ltd. It concerned land including Swanlinbar Quarry, a cement plant and parts of the roadway between them in Co Cavan.
Ms Justice Emily Egan said Quinn had been on the companies’ land without permission despite repeated requests to stop. She was satisfied that unauthorised access to the active quarry raised health and safety concerns and awarded costs against him.
Quinn was absent from court and faces jail if found to be in breach of the injunction.
In a letter emailed to the court on 20 May, Quinn said he could not attend at that stage because of short notice. He disputed the claim that his presence posed a health and safety risk and offered an undertaking not to visit Mannok sites if his access to a roadway was not inhibited. He said he needed the road for business reasons, including discussions about a prospective wind farm.
For the companies, Andrew Fitzpatrick SC said Quinn had offered no evidence of an entitlement to access their land. He said another area Quinn sought to reach was accessible from a public road and that the companies could not agree to the conditions attached to his proposed undertaking.
