High Court extends injunction over Wicklow data-centre site and rejects McDonaghs’ interim bid

By Donal Gilhooly

This report is a localnews.ie summary based on public court reporting and records; sources are listed below.

The High Court extended an injunction preventing Brian McDonagh from trespassing on or interfering with an 82-acre site at Mount Kennedy, Kilpedder, earmarked for a data centre. It also rejected a separate pretrial motion by Brian, Maurice and Kenneth McDonagh seeking to stop Fane Investments and related parties from marketing, leasing or disposing of the land before their claim was heard.

The brothers’ underlying claim concerns an alleged 2017 agreement to form a 50-50 partnership and develop the site through a special-purpose vehicle. The defendants denied the claim, saying conditions in the proposed deal had not been met. The judge said he was making no final determination, but considered damages an adequate remedy if the brothers ultimately succeeded. The case was adjourned after directions were made for the exchange of documents and pleadings.

This report covers an earlier stage of the case. Later developments are not reported here.
