Brian McDonagh restrained over trespass on data centre land

This report is a localnews.ie summary based on public court reporting and records; sources are listed below.

Brian McDonagh was restrained from trespassing on Fane Investments Limited’s Wicklow land by the High Court on 20 July 2022.

Mr Justice Tony O’Connor extended the injunction Fane had obtained in June, after finding that Mr McDonagh was not the owner and at most had an interest through a company set up for the project.

The injunction concerns an 82-acre site at Mount Kennedy, Kilpedder, earmarked for a data centre. Mr McDonagh opposed Fane’s application and denied wrongdoing, saying his wife kept two horses there and they had grazing rights.

The judge said the parties should arrange removal of the horses; if they could not agree, Fane could bring fresh proceedings. A separate motion by Mr McDonagh and his brothers seeking to restrict Fane’s dealings with the land was dismissed, without a final decision on their claim.
