The High Court delivered a judgment in TikTok Technology Limited and Anor v Data Protection Commissioner [Administrative Fines] on 30 June 2026.

Earlier, on 30 April 2026, the Supreme Court confirmed that TikTok could continue transferring data from the European Union to China while it appealed the Irish regulator’s order to halt the transfers. The court said the stay should remain in place until the High Court gave judgment in the appeal against the fine and transfer ban, which had already been heard.

The dispute concerned a €530 million fine and an order requiring TikTok to suspend transfers to China if its processing was not brought into compliance within six months. The High Court had stayed the transfer ban in November, citing limited and temporary consumer risk and the difficulty of quantifying the damage TikTok could suffer from a suspension.

The regulator said TikTok had failed to ensure that data accessed remotely by personnel based in China received protection essentially equivalent to that provided in the European Union. TikTok said it had never received a request for European user data from the Chinese authorities or provided such data to them. It also said the regulator had failed to fully consider security measures that independently monitor remote access.
