High Court allows teenager to challenge suspended sentence linked to lack of hostel places

By Gráinne Nolan

This report is a localnews.ie summary based on public court reporting and records; sources are listed below.

The High Court granted a 16-year-old, whose name is withheld, permission to challenge a District Court sentence imposed last July. His three-month prison term was fully suspended for six months. His case seeks to quash the sentence, alleging that a suitable hostel was unavailable for a residential supervision order.

At the High Court, the teenager’s counsel said he had been eligible for a Probation Residential Supervision Order, but no suitable premises was available. His father’s court affidavit described concerns about the boy’s care and supervision. These are submissions in the case, not findings by the High Court.

Ms Justice Mary Rose Gearty granted leave on the ex parte application and adjourned the matter to November. The challenge therefore remained pending in the reported account.
