Mr Justice Paul Gilligan adjourned the High Court dispute over The Gables premises on 9 July 2014 to give the parties time to reach agreement. The proceedings were reported on 10 July 2014. The case was due to return the following day.
On 8 July 2014, the court heard of a stand-off between John and James McCabe and agents for the property's owner. The pair were directors of the company running The Gables restaurant and wine bar at Torquay Road in Foxrock.
That company, McCabes Wine Warehouse Ltd, had operated there under lease since 2001, running a restaurant and wine shop. Daphne Kaye had bought the property in 1999.
Matthew Jolley, representing Daphne Kaye, told the judge on 8 July 2014 that her agents had tried to recover possession. He said the company had failed to pay approximately €379,000 in rent arrears.
Daphne Kaye brought proceedings alleging trespass by the McCabes and sought orders directing them to leave. Matthew Jolley obtained permission for her proceedings against McCabes Wine Warehouse Ltd to be served at short notice.
