The High Court adjourned extradition proceedings concerning Liam Patrick Daly, who was wanted in Germany over an allegation of attempted aggravated robbery at a Berlin takeaway. The hearing before Mr Justice Kerida Naidoo took place on 18 April 2023. The proceedings were reported on 19 April 2023.
The warrant alleged that on 18 February 1994 Daly entered the takeaway with a mask on his head and a broken wooden chair leg, attempted to strike a worker and intended to take money. The worker fended off the alleged attack without injury. Daly’s barrister, Willie Hughes BL, said his client had no recollection of the events because of intoxication.
Mr Hughes argued that the delay made surrender unjust and oppressive. He said Daly had been released after three days in detention, had nominated his fiancée’s address for legal documents and had not sought to evade authorities. A UK extradition case in 2003 resulted in a refusal to surrender Daly over the same matter, Mr Hughes said.
Mr Justice Naidoo said the long delay did not itself amount to an abuse of process. He said Daly had known papers were to be served at the nominated address but had then moved. Anthony Hanrahan BL, for the Minister for Justice, submitted that the warrant had been amended in 2007 to the sole charge of attempted aggravated robbery, removing a charge of attempted bodily harm.
The judge adjourned the matter until the following Tuesday for inquiries about a newly mentioned UK warrant and whether the Minister knew of any new warrant in Ireland.
