Hellfire Massy Residents Association loses planning appeal

By Fionn Kelly

This report is a localnews.ie summary based on public court reporting and records; sources are listed below.

The Hellfire Massy Residents Association’s appeal against planning permission for the Hellfire Club visitor centre was dismissed by the Supreme Court on 24 October 2022.

The five-judge court held that a pending decision of the Court of Justice of the European Union on related legal questions could not affect the validity of the permission. The association had argued that the High Court should have delayed deciding its challenge until the European court ruled.

The Supreme Court also pointed to a lack of clarity in the association’s legal pleadings and said planning permission challenges should normally be resolved promptly. The High Court had previously dismissed the group’s claim, and the Supreme Court agreed with the reasoning for dismissing its appeal.
