Graham Daly’s rape and abuse conviction appeal dismissed

By Rory Hanlon

This report is a localnews.ie summary based on public court reporting and records; sources are listed below.

Graham Daly’s appeal against his conviction for raping and sexually abusing his younger brother was dismissed by the Court of Appeal on 3 November 2023.

Daly had been convicted by a jury of seven counts involving abuse between January 1998 and December 2002, after a Central Criminal Court trial in December 2021. Most of the abuse took place at the family home in County Limerick.

The appeal challenged restrictions on cross-examining the complainant about his sexual history and the admission of evidence from a cousin. The Court of Appeal upheld the trial judge’s decisions, finding the questioning limits struck the right balance between fair-trial rights and the complainant’s privacy.

The court also dismissed the challenge to the cousin’s evidence, finding no unfairness or prejudice to Daly’s ability to receive a fair trial.
