Gerard Martin Fulham loses appeal over unlawful imprisonment claim

By Gráinne Nolan

This report is a localnews.ie summary based on public court reporting and records; sources are listed below.

Gerard Martin Fulham’s appeal against the dismissal of his unlawful imprisonment damages claim was dismissed by the Court of Appeal on 12 March 2021.

The court upheld the High Court order striking out proceedings against Chadwicks Limited, Independent Newspapers (Ireland) Limited, Ireland and the Attorney General as frivolous and vexatious, disclosing no cause of action and bound to fail. It also upheld the respondents’ costs orders. Mr Fulham had claimed damages arising from his imprisonment in Mountjoy Prison in December 2007, but the court held that the 2009 declaration concerning the relevant legislation did not retrospectively support his claim.
