Gemma Ni Chionnaith’s negligence claim over advice on an unfair dismissal case will proceed after the High Court rejected a bid to strike it out, in a judgment reported on 8 April 2022.

Ms Justice Siobhan Phelan found there had been inordinate delay, but ruled that the balance of justice favoured allowing the case to proceed to a full hearing. She also awarded Ms Ni Chionnaith the costs of the motion.

The claim concerns advice allegedly given by barrister John Fahy and services allegedly provided by the National Union of Journalists in connection with her unsuccessful unfair dismissal claim against RTÉ. Both defendants deny the allegations.
