Gary Lennon faces AIB guarantee claim as Master warns on records

Master of the High Court Edmund Honohan adjourned generally AIB’s application for final summary judgment against company director Gary Lennon. He also warned that hearsay business records should be excluded from evidence unless certain criteria are met. The proceedings were reported on 16 February 2022.
AIB alleges that Gary Lennon gave a personal guarantee for credit facilities advanced in August 2009 to Forrest Lennon Business Support Services. The bank says it demanded repayment in 2017 and seeks €150,000 plus interest.
Gary Lennon says the bank was repaid all money due under the guarantee and wrongly commenced proceedings. He also claims AIB failed to bring the action within the six-year statutory period.
The Master said AIB had provided an unsigned, undated notice listing about 15 documents it intended to rely on, but no admissible evidence supporting their admission. He said a party seeking to enforce a guarantee needs a paper trail and that a complex case needs a full trial.
