Gary Flynn has pleaded not guilty to murder. The charge concerns the shooting of Seamus ‘Shay’ O’Byrne at Tymon Park North in Tallaght on 13 March 2009. His trial was being heard at the Central Criminal Court before Judge Patrick McCarthy and a jury. The proceedings were reported on 1 February 2016.

Det Sgt Daniel Kelly gave evidence that Gardaí traced a Red Bull can recovered at the shooting scene from a factory in Switzerland to a Spar shop in Ballymount. The report said the distributor showed that the can had been delivered to the shop on 16 January 2009.

Garda Patrick Tarrant told prosecuting counsel Alex Owens SC that CCTV stills showed Garrett O’Brien buying two cans at the shop at 6.35pm on the day of the shooting. The report said Seamus ‘Shay’ O’Byrne was shot shortly after 8pm. Garda Patrick Tarrant said Garrett O’Brien’s green rain jacket matched one found in a vehicle believed to have been used by the gang believed responsible for the killing.

Alex Owens SC said the prosecution intended to show that Gary Flynn was part of a group that planned and carried out the killing. The trial was continuing.
