Gareth Brophy was refused bail on a charge of murdering David Douglas at the Central Criminal Court on 21 December 2018. Douglas was shot six times during a meal break at his partner’s shop, Shoestown, on Bridgefoot Street, Dublin, on 1 July 2016.
A book of evidence was served on Brophy on 20 December 2018 and he was sent forward for trial at the non-jury Special Criminal Court. He applied for bail to Ms Justice Tara Burns on 21 December, but the State objected.
Under cross-examination by defence counsel David Perry, Sergeant Brendan Brogan accepted that Brophy’s mother, two brothers, two sisters and young child lived in the Dublin area. He also accepted that Brophy was in a steady relationship with a partner who lived in Dublin and had close ties to the city.
Mr Perry asked the judge to consider those family ties, saying they anchored Brophy to Dublin and the jurisdiction. He said Brophy had sourced €5,000 from family members and was prepared to offer it for bail. Ms Justice Burns refused bail, saying it was reasonably possible that Brophy would abscond if released.
