Gardaí to reconsider Palestinian man’s complaint over West Bank rentals after High Court quashes decision

The High Court quashed An Garda Síochána’s decision not to investigate a Palestinian man’s complaint about Airbnb listings for cabins on his land in the West Bank. The man, whose name is withheld by court order, brought the judicial review against the Garda Commissioner with Sadaka – The Ireland Palestine Alliance.

On 16 October 2025, Aoife McMahon, barrister for the man, told Ms Justice Mary Rose Gearty that the commissioner was conceding certain reliefs sought and that gardaí would reconsider the complaint. Remy Farrell SC, for the commissioner, said there was consent to the reliefs. Ms Justice Gearty then made the order quashing the decision.

The complaint alleged that Israeli settlers built cabins on the man’s land and that Airbnb’s Irish operations allowed them to be rented. The man claimed the listings and bookings involved offences under Irish law. Those remain allegations; the court’s order concerned the Garda decision.

An Airbnb spokeswoman said the company operates in compliance with applicable laws in Ireland. She said its policy since 2019 has been to donate all profits generated from the very small number of bookings in the entire West Bank.
