Garda Commissioner wins Supreme Court appeal over disciplinary use of phone evidence

The Garda Commissioner won an appeal to the Supreme Court against a ruling that phone evidence could not be used in disciplinary proceedings against Garda Patrick Hyland. The decision was delivered on 6 November 2025.

The case arose from an investigation into an allegedly pornographic video shared in a Garda WhatsApp group. Hyland denied wrongdoing, and the Director of Public Prosecutions decided not to prosecute him.

The majority held that the Commissioner could use knowledge gained from the lawful search to begin disciplinary proceedings. Whether material copied before the no-prosecution decision and Hyland’s demand for the phone’s return could be used directly depended on further legal and factual questions.

The judges also ruled that material copied or downloaded after the no-prosecution decision and Hyland’s demand for the phone’s return could not be used in the disciplinary investigation. Two judges dissented, finding no lawful basis for using warrant-obtained material in an internal investigation.
