Eric Eoin Marques loses extradition appeal over child pornography charges

By Eimear Byrne

This report is a localnews.ie summary based on public court reporting and records; sources are listed below.

Eric Eoin Marques lost his extradition appeal and challenge to an Irish non-prosecution decision in the Court of Appeal on 12 December 2016. He was wanted in the United States on charges of conspiring to distribute and advertise child pornography.

The court upheld the conclusion that the Director of Public Prosecutions was not obliged to give reasons for deciding not to prosecute him in Ireland. It also rejected his argument that the potential US sentencing regime created a substantial or real risk of unfairness.

The report says final orders were due to be determined the following week. The allegations underpinning the US charges were not findings that Marques committed the offences.
