Emmet Fogarty was sentenced to seven and a half years in prison, with the final two and a half years suspended for that period. The proceedings were reported on 27 November 2018.
Fogarty pleaded guilty at Dublin Circuit Criminal Court to possessing cocaine, cannabis herb and cannabis resin worth €1,398,714. He also pleaded guilty to unlawful possession of .44 Remington caliber, Magnum caliber and .22 LR caliber ammunition. The offences occurred at a lock-up unit at Mount Dillon Business Park, Malahide Road, Dublin 5, on 31 March 2017.
Judge Melanie Greally said Fogarty played “an extremely important role” in the enterprise and took the risks by leasing the unit. She took his personal circumstances and difficult background into account when imposing sentence. His defence counsel, John Fitzgerald SC, had asked her to consider his medical difficulties, early guilty plea, lack of relevant previous convictions and the fact that he had never been in custody.
