Dublin woman’s reckless endangerment appeal dismissed

This report is a localnews.ie summary based on public court reporting and records; sources are listed below.

A Dublin woman’s appeal against concurrent sentences of five years and three years for two counts of reckless endangerment of children was dismissed by the Court of Appeal on 7 December 2023.

The judgment was delivered by Ms Justice Isobel Kennedy. The woman had pleaded guilty after fixing a trial date and accepted her culpability. Five counts of child cruelty were taken into consideration.

The appeal challenged the failure to suspend part of the custodial sentence, relying on her lack of previous convictions, substance and mental-health difficulties, remorse and rehabilitation efforts. The court held that the sentencing judge was entitled to impose the sentences without suspension, and dismissed the appeal.
