The Director of Public Prosecutions will not proceed with a third trial of a man accused of raping a friend in Dublin in 2008. Prosecutors told the Central Criminal Court that no jury would be required and that they had been instructed to enter a nolle prosequi on the single charge. The man, who cannot be named for legal reasons, had denied the allegation in two earlier trials.
The first trial collapsed in 2015 over legal issues shortly before jury deliberations. A jury in the second trial, in 2016, could not agree a verdict after more than eight hours of deliberations. The accused had said he might have had sex with the woman but claimed he was suffering from sexsomnia at the time.
