Donal Colgan’s jury was discharged in the Central Criminal Court murder trial on 24 November 2016.
Jurors found a 29-second gap in CCTV footage after deliberating for about three hours.
Justice Carmel Stewart said the missing footage could have been significant and had not been identified by either legal team.
Colgan had pleaded not guilty to murdering David Sheridan outside a North Strand Road chip shop in August 2014.
The judge said witnesses had given evidence and been questioned on the basis that the footage was continuous.
She concluded that fair procedure required the jury to be discharged and said Colgan would return to court on 19 December.
