Deniss Kovalenko wins rape exclusion challenge

By Aoife Loughran

This report is a localnews.ie summary based on public court reporting and records; sources are listed below.

Deniss Kovalenko won his High Court challenge over removal after a rape conviction, reported on 20 January 2015.

He was convicted of raping and orally raping an American student in Galway on 14 February 2004, and jailed for seven years.

Mr Justice Paul McDermott ruled the exclusion order fundamentally flawed because Kovalenko was denied fair procedures before his removal from Ireland.
