Declan Rogers denied breaching court orders over rent collection at the High Court, when the contempt application was heard on 13 July 2023. The dispute concerns Ossory Road Business Park in Dublin 3.

Ossory Road Enterprise Park Limited sought Rogers’ attachment and committal for allegedly collecting rent despite an injunction barring him and Rogers Recycling Limited from collecting or attempting to collect rents from certain units. Rogers disputed the plaintiff’s claim to ownership of the park and the rents.

The plaintiff alleged repeated breaches. Rogers rejected the allegations, and his counsel argued that the evidence was insufficient to commit him to prison.

Mr Justice Brian Cregan adjourned the hearing after submissions. He said the defence had raised valid points about the evidence and the standard of proof for imprisonment for contempt, and proposed returning to the application in October after the plaintiff addressed additional reliefs.
