Dean Boland’s manslaughter conviction was quashed by the Court of Appeal in a judgment delivered on 7 October 2025.
The court ruled that Mr Viera’s voluntary return to the burning property broke the chain of causation; Boland’s arson was not the cause of his death.
Boland had been convicted by a Dublin Circuit Criminal Court jury in December 2022 of the unlawful killing of Ohari Viera, arson damage and burglary at Oaklands Terrace, Terenure.
The Court of Appeal remanded him in custody to appear before Judge Elma Sheahan on 10 October 2025 in relation to the other two charges.
