David Lynch fails burglary conviction appeal

By Fionn Kelly

This report is a localnews.ie summary based on public court reporting and records; sources are listed below.

David Lynch’s appeal against his burglary conviction was dismissed by the Court of Appeal on 14 November 2022. He had also been convicted of possessing a knife, criminal damage and obstructing a peace officer.

Garda Stephen White arranged to meet Lynch after answering a phone recovered from the burglary scene. Lynch said he had lost it, and met White in plain clothes without knowing he was a garda. White arrested him after Lynch identified the phone as his own; a search later recovered jewellery taken from the house.

The appeal court found no error in the trial judge’s ruling. It said White was entitled to ask about ownership of the phone, and that suspicion crystallised when Lynch recognised a sticker on it.
