David Lynch’s appeal against convictions for burglary, possession of a knife, criminal damage and obstruction of a peace officer was dismissed by the Court of Appeal. He had been sentenced to three years and three months in prison.
Ms Justice Isobel Kennedy said the court found no error in the trial judge’s ruling. The defence argued that Garda Stephen White should have cautioned Lynch before he identified himself as the owner of a phone recovered at the burglary scene, and that evidence from a later search should be excluded.
The court found the Garda’s questions about ownership were permitted and that suspicion crystallised only when Lynch identified the phone. The proceedings were reported on 14 November 2022.
