D. W. appealed 30-year no-contact condition after assault conviction

By Fionn Kelly

This report is a localnews.ie summary based on public court reporting and records; sources are listed below.

D. W. appealed a 30-year no-contact condition attached to his sentence for assault causing harm. The Court of Appeal judgment was delivered by Mr Justice Edwards on 2 June 2020.

On 9 November 2018, a jury unanimously found D. W. guilty of assault causing harm. It acquitted him of two other charges: making a threat to kill or cause serious injury, and false imprisonment.

He received four years’ imprisonment, with the final year suspended for three years. The suspension required him to enter a €150 bond to keep the peace and be of good behaviour during that period. A further condition required him for 30 years to stay away from the injured party and any property where she lived or would live, and not to contact her or cause anyone else to contact her.

The appeal focused solely on the 30-year condition. D. W. and the injured party had four children together. The available extract of the judgment sets out the appeal but does not include the court’s decision.

This case may have concluded differently. The outcome has not yet been confirmed by a public source we could find.
