The Court of Appeal judgment in John McCormack’s proceeds-of-crime property case was delivered on 18 June 2021.
The case concerns three properties at Purcell Park in Shannon, Cloontra West in Co Clare and Claughan Fort in Limerick. A High Court order made on 20 July 2020 followed a finding that evidence established, on a prima facie basis, that the properties were likely acquired with proceeds of serious criminal activity.
The Court of Appeal judgment records that McCormack was the respondent in the original proceedings and the appellant in the appeal. It also says the High Court found that evidence from senior Garda officers supported CAB’s case, while McCormack’s evidence did not displace the inference arising from it.
