The Court of Appeal has dismissed Lee Canavan’s appeal against his convictions for murder and criminal damage. The court held that the trial court could consider whether he was involved in a common design to murder David Douglas, even though it did not find that Canavan was the gunman. It also found the guilty verdicts were not perverse.
Canavan appealed several aspects of the trial, including the admission and assessment of identification evidence, the finding that his association with others indicated guilt, and the conclusion that he had the required intent for murder. The appeal judgment says the identification challenges went to the weight of the evidence, which was for the trial court to assess.
Canavan was convicted by the Special Criminal Court in 2021 of murdering Douglas and damaging a Suzuki Swift. The Court of Appeal judgment is dated 19 December 2025.
