Cornelius Minihane’s fishing capacity case reached the Court of Appeal in a judgment delivered on 22 March 2022, with costs the only issue before the court. The appeal arose from a High Court injunction concerning an agreement to sell him 324 gross tonnes of fishing capacity for €900,000. The agreement provided for a €90,000 deposit, which Minihane paid, and he later commissioned a new vessel. The High Court had granted the injunction after finding that Minihane had raised a fair issue to be tried and that the balance of convenience favoured him. The Court of Appeal recorded that the substantive issues had become moot, although the parties did not agree on that point.
