Consultant engineers and Limerick County Council were found responsible for the wrongful demolition of a family home in the High Court. The proceedings were reported on 23 June 2015. The home, at Annaholty, Birdhill, Co Tipperary, was demolished on 6 September 2006 during construction of a dual carriageway between Limerick and Nenagh. The site was never used for the road.
Mr Justice Donald Binchy found the RPS Scetauroute joint venture 70% responsible and the local authority 30% responsible. The judgment recorded that the demolition followed errors involving the designation, photographing and labelling of a property plot, together with failures to check the site boundaries and the works being carried out.
The third party that carried out the demolition was found not to be negligent.
