Charlie Jennings wins permission in land sale case

This report is a localnews.ie summary based on public court reporting and records; sources are listed below.

Charlie Jennings brought High Court proceedings against Promontoria (Oyster) DAC seeking to complete the sale of 46 acres at Castletown, Co Meath. He says he needs a net redemption figure to allow the sale and repayment of approximately €257,000 outstanding on loans. The proceedings were reported on 11 December 2018.

Jennings said Promontoria had sent him a redemption figure following correspondence in August. He claimed it included sums due on a mortgage taken out by his son, which Jennings had guaranteed, and a joint mortgage with a business partner. He said the fund was asserting a right to seek payment on those mortgages under ‘all sums due’ clauses.

He seeks orders requiring the fund to provide a redemption figure and facilitate the sale, as well as declarations that it cannot prevent the transaction. Ms Justice Leonie Reynolds granted permission on an ex parte basis to serve short notice of the proceedings. The matter was due back before the court the following week.
