Charlie Farrelly won his challenge to Kerry County Council’s appointments to a development board in the High Court on 16 May 2022.
Ms Justice Niamh Hyland found the council’s successive voting procedure was unavailable because no qualifying group had nominated a candidate.
She ruled that the appointments of Councillors Sheehy and Kennelly to North, East & West Kerry Development were unlawful.
The judge quashed the council’s decision of 16 November 2020, and granted Farrelly’s application.
