Cabhrú allowed to renew bid for orders over Dublin property

This report is a localnews.ie summary based on public court reporting and records; sources are listed below.

The High Court has allowed Cabhrú Housing Association to renew its application for attachment and possible committal orders against people occupying its Dublin 7 property. The proceedings were reported on 20 June 2023.

On 20 June, Mr Justice Brian O’Moore granted permission to renew the application and adjourned the matter to a date later that month. Barrister Andrew Whelan, for Cabhrú, said the association believed members of a group calling itself the Revolutionary Housing League were occupying the building. He said efforts to identify them had been difficult because occupants were covering their faces.

The previous week, Mr Justice Rory Mulcahy had refused orders directing gardaí to arrest the unknown occupants and bring them before the court. He cited a lack of evidence about their identities and was not satisfied that all those alleged to be occupying the property had been made aware of an earlier injunction requiring them to leave.

The judge said further efforts were needed to identify the occupants and properly serve them with the proceedings before the orders sought could be granted. He said Cabhrú could renew its application later.

Cabhrú claims James McSweeney House on Berkeley Street was taken over the previous month by persons unknown. The charity wants to regain and redevelop the property as housing units for older people.
