Brian McDonagh injunction continued over Wicklow trespass

The High Court continued an injunction against Brian McDonagh over alleged trespass on Wicklow lands on 20 July 2022.

The order restrains him from trespassing on or interfering with an 82-acre property at Mount Kennedy, Kilpedder, earmarked for a data centre.

The judge said the evidence satisfied him that McDonagh did not own the lands and had, at most, an interest through a special purpose vehicle.

McDonagh denied wrongdoing and said his wife had kept two horses there for about 15 years, with grazing rights.

The judge said the parties should arrange the horses’ removal; Fane Investments could bring fresh proceedings if they could not agree.

The judge also refused the McDonagh brothers’ request to prevent Fane and related parties from marketing, leasing or disposing of the lands before their claim is heard.

He said damages would be an adequate remedy if the brothers succeeded, without making a final determination of their claims over an alleged 2017 partnership agreement.
