Brandon Crosbie’s appeal against his reckless endangerment sentence was dismissed by the Court of Appeal on 31 January 2019. Mr Justice McCarthy delivered the court’s judgment.
Dublin Circuit Criminal Court had imposed the sentence on 7 February 2018. Crosbie had pleaded guilty to three counts of reckless endangerment, one count of dangerous driving and one count of driving without insurance.
The judgment said he had faced 21 offences in all, including 18 under the Road Traffic Acts. The sentencing judge took two of the reckless endangerment counts, the dangerous driving and insurance counts, and the remaining counts on the indictment into consideration.
Crosbie argued that the trial judge had failed to balance punishment, deterrence and rehabilitation and to impose a sentence proportionate to the offence and his circumstances. The Court of Appeal held that the sentence was within the Circuit Court judge’s discretion.
