Ann Fennell’s proposed Personal Insolvency Arrangement was rejected by the High Court, reported on 29 April 2021. The plan would have required her to continue mortgage repayments until she was 98, with the court finding she was not reasonably likely to comply with its terms. Mr Justice Mark Sanfey also found that a restructured loan extending beyond the debtor’s likely lifespan was not permissible and that the proposed payments had not been shown to be affordable or sustainable. The court dismissed her appeal, while the case was due to return for final orders.
