Andrius Lipinskas challenged convictions in Court of Appeal

By Fionn Kelly

This report is a localnews.ie summary based on public court reporting and records; sources are listed below.

Andrius Lipinskas appealed his convictions for three counts of rape under section 4, aggravated sexual assault and burglary. He was convicted on 5 June 2019 and was subsequently sentenced to a lengthy term of imprisonment.

The Court of Appeal judgment was delivered by Birmingham P on 21 February 2020.

The judgment described an attack on a woman at her home in Finglas, Dublin, on 2 August 2010. A partly smoked cigarette was retrieved from the house. Its DNA profile matched a profile generated from a sample Lipinskas provided in Lithuania on 20 February 2012.

Lipinskas was later surrendered to Ireland under European Arrest Warrant provisions. He was arrested at Dublin Airport on 28 August 2017 and charged at a Garda station in the presence of a Lithuanian interpreter.

His appeal challenged the admission of the Lithuanian DNA sample and his response after being cautioned at Finglas Garda station. On his behalf, it was submitted that the procedures in Lithuania had to accord with Irish law; his written submissions said he had not been arrested at the police station there or had the relevant parts of the Criminal Justice (Forensic Evidence) Act 1990 explained to him.

This report covers an earlier stage of the case. Later developments are not reported here.
