An Bord Pleanála refused appeal over Monkstown homes ruling

An Bord Pleanála’s appeal bid over the quashing of planning permission for homes in Monkstown was refused by the High Court, reported on 20 January 2023.

Mr Justice David Holland rejected each ground advanced by the board, saying its submissions did not raise a point of law of exceptional public importance. The original ruling quashed permission after finding errors in building-height policy and two failures relating to environmental impact assessment.

The permission covered 276 apartments and 22 houses at Dalguise House. The board’s remaining option was to seek permission from the Supreme Court for a direct appeal.
