Alexander Rojas Rey wins appeal over mescaline conviction

By Cathal Brosnan

This report is a localnews.ie summary based on public court reporting and records; sources are listed below.

Alexander Rojas Rey’s conviction for possessing mescaline was quashed by the Court of Appeal, in a judgment reported on 25 February 2022.

He had been found guilty after a trial of possessing mescaline for sale or supply and possessing the drug, and received 100 hours of community service in November 2019 instead of 12 months’ imprisonment at Cork Circuit Criminal Court. The appeal court ruled that the jury should not have been left to decide as a matter of law whether the substance was controlled under the Misuse of Drugs Act.

A hearing on whether he should face a retrial was scheduled for the following month.
