Alan O’Brien failed to have false imprisonment and assault causing serious harm charges dismissed at the Special Criminal Court on 29 July 2020. The charges relate to the alleged assault of Kevin Lunney at Drumbrade, Ballinagh, Co Cavan, on 17 September 2019. O’Brien had applied to the non-jury court under Section 4E of the Criminal Justice Act 1999.

Mr Justice Paul Coffey, sitting with Judge Martin Nolan and Judge Gerard Griffin, said the court was satisfied there was sufficient evidence to put O’Brien on trial. He was remanded in custody until 11 January 2021, when his trial was expected to take place alongside three co-accused.
