Adam Fitzgibbon wins appeal over serious-harm sentence

By Saoirse Doyle

This report is a localnews.ie summary based on public court reporting and records; sources are listed below.

Adam Fitzgibbon won an appeal at the Court of Criminal Appeal, reported on 25 March 2014, over his serious-harm sentence. The offence occurred at a Corbally service station on 23 July 2010. Fitzgibbon had pleaded guilty to intentionally causing serious harm after attacking a 16-year-old schoolboy. He was originally sentenced to 15 years, with the final three years suspended.

The three-judge appeal court ruled that the sentencing judge had wrongly excluded Fitzgibbon’s drink and drug use from mitigation. The court indicated that the sentence would be reduced.

This case may have concluded differently. The outcome has not yet been confirmed by a public source we could find.
