Adam Fitzgibbon appeals sentence for attempted murder attack

By Orla Quinn

This report is a localnews.ie summary based on public court reporting and records; sources are listed below.

Adam Fitzgibbon is appealing a 15-year sentence imposed at the Central Criminal Court after pleading guilty to intentionally causing serious harm, a lesser charge than attempted murder. The proceedings were reported on 9 October 2013.

The sentence followed an attack on a 16-year-old boy outside a Corbally petrol station on 23 July 2010. The report said Fitzgibbon repeatedly kicked the boy in the head, leaving him with permanent brain damage. Fitzgibbon said he was under the influence of drink and drugs. The final three years of his sentence were suspended.

The appeal was before the Court of Criminal Appeal, which had reserved its decision. Defence counsel argued that Mr Justice Paul Carney was wrong to exclude Fitzgibbon’s consumption of intoxicants from mitigation.
