Aberken and Hyper Trust substantially settled their business interruption claims against FBD at the High Court on 3 November 2022, after lengthy discussions over losses caused by Covid closures.

Counsel told Mr Justice Denis McDonald that some matters still needed to be finalised, and asked him to adjourn the case to Friday, 4 November. Both sides also sought clarification of legal principles affecting any final settlement agreement.

The settlement discussions concerned the amount payable under policies covering business disruption. In an earlier ruling, the judge held that FBD’s policy covered losses pubs sustained when they had to close during the pandemic.
