Abdul Malik Bekmirzaev wins permission for passport challenge

By Gráinne Nolan

This report is a localnews.ie summary based on public court reporting and records; sources are listed below.

Abdul Malik Bekmirzaev was granted permission to challenge the refusal to issue him an Irish passport in the High Court on 5 November 2020. The challenge concerns the State’s decision not to recognise him as an Irish citizen after his father’s naturalisation was retrospectively revoked.

Bekmirzaev, who is living in Belarus with his mother, seeks orders requiring the issue of an Irish passport and declarations confirming that his father’s revoked citizenship does not affect his own citizenship. The proceedings name the Minister for Justice, the Minister for Foreign Affairs, Ireland and the Attorney General as respondents.

Ms Justice Tara Burns granted permission on an ex parte basis, and the matter was due to return before the High Court in December 2020.
