The Labour Court upheld an Adjudication Officer’s decision after a worker’s appeal over an alleged victimisation complaint against ESB Networks failed. The determination was signed on 5 July 2023. The worker, represented by the Independent Workers Union, argued that ESB Networks did not engage in collective bargaining with that union. The Court found that the relevant protection applied only where collective bargaining was not the employer’s practice. It said ESB Networks did engage in collective bargaining, so the appeal failed.
